1. ACCEPTANCE OF TERMS

Welcome to Avail Event Manager. Avail Event Manager provides its service to you, subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. By utilizing this web site for any purpose, you expressly agree to these terms and conditions set forth herein. Furthermore, you agree to waive all rights to litigation and/or compensatory damages regarding the use of this web site.

2. DESCRIPTION OF SERVICE

Avail Event Manager is a lead generation program which provides you with html code to put on your site that will generate a button on that website. The purpose of this button is to persuade brides to check their date with your availability calendar, which will also persuade them to send you their contact information. Avail Event Manager also allows you to keep each of your bookings organized in your own online account.

3. NO WARRANTY OR GUARANTEE

Though Avail Event Manager is a tool to use to draw in more business, Avail Event Manager makes no warranty or guarantee of increase in your sales. Your increase in sales is contingent upon utilization of other tools as well, such as internet presence on top search engines, website optimization, proper keywords, proper descriptions, ad placements, bridal shows, etc. And, as Avail Event Manager is only one of such tools we can make no specific guarantees as to your success with this program.

4. MEMBER ACCOUNT, PASSWORD AND SECURITY

You will receive an email accepting your username and password upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Avail Event Manager of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Avail Event Manager cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 4.

5. TERMINATION.

You agree that Avail Event Manager may, under certain circumstances, terminate your account. Reasons for termination may include: failure to pay your monthly payments, inappropriate behavior towards potential clients or other vendors. In any case of termination of services, you will be given 2 warnings by email, and unless behavior or non-payment is changed your 2 warnings will be followed by an email notification of termination.

6. DEALINGS WITH OTHER VENDORS OR POTENTIAL CLIENTS

Your correspondence or business dealings with, other vendors or potential clients found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such vendor or potential client. You agree that Avail Event Manager shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.

7. PRIVACY POLICY

As per our privacy policy, you agree to respect the privacy of potential clients. To ensure the protection of this privacy, you agree not to sell or give any potential client’s contact information to any other company without that client’s permission. You also agree to respect any potential client’s expressed request to be removed from any further emails, mailings, or phone calls if they so desire.

8. MODIFICATIONS TO SERVICE

Avail Event Manager reserves the right at any time and from time to time to temporarily modify the Service (or any part thereof). Should such modifications be necessary we may have to suspend services for a short time, during which you will be notified and kept up-to-date. You agree that Avail Event Manager shall not be liable to you or to any third party for any modification or suspension of the Service.

9. NO RESALE OF SERVICE

You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

10. INDEMNITY

You agree to indemnify and hold Avail Event Manager, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

11. VIOLATIONS

Please report any violations of the TOS to us through our phone or email. Any and all violations of the TOS will be dealt with immediately.
